Heard learned counsel for the rival parties. It is not in dispute that the applicant is untraceable since the date of commission of the offence. This Application for anticipatory bail was filed in this court on 12.1.2016. The relief cannot extended to a person who do not avail the remedy at the earliest. Learned counsel for the applicant contended that there is absolutely no evidence against the applicant and, therefore, his request for anticipatory bail should be considered. I do not agree with him, for the simple reason that according to learned APP the charge-sheet shows involvement of the applicant, though as a conspirator. But then the applicant should not have absconded for such a long period. This dis-entitles him from claiming the said relief.

The instant Application is therefore disposed of reserving liberty in favour of the applicant to
