This petition takes exception to the order dated 10-11-2023 passed below Exhibit-35 in L.A.R. No.106/2020 whereby the application filed by the petitioner for fresh joint measurement came to be rejected.

Heard learned Counsel for both the sides.

It is not in dispute that the reference is for apportionment of the compensation and that the award passed on the basis of joint measurement was not challenged by any party before any competent Court of law. Needless to say that the said award has attained finality.

In this backdrop, the learned Reference Court holds that the joint measurement report and the award passed thereon is not challenged. This finding of the Court in the context of the issue involved before the Reference Court cannot be faulted with.

As a result of this, no case is made out to cause interference in the order impugned. Hence, the petition stands dismissed.
