In the present writ petition, the order below Exhibit 25 is under challenge whereby the application for direction to defendants to deposit Rs.1500 in the Court as damages, came to be rejected vide impugned order dated 19th October, 2019 passed by the 19th Joint Civil Judge, Senior Division, Nagpur in Regular Civil Suit No.384 of 2016.

This order was passed on 19th October, 2019 and since then for last four years, there is no order SKNair

In the meantime, the suit has reached to the stage of recording of the evidence. In that view of the matter, the ends of justice would be subserved if the writ petition is disposed of with a direction to the trial Court to decide the suit expeditiously.

Accordingly, the writ petition is disposed of. 6.

The trial Court is directed to decide the Regular Civil Suit No. 384 of 2016, expeditiously and in any case within six months from today.
