Present application is filed for condonation of delay in filing First Appeal. There is delay of 297 days in filing First Appeal.

None for respondent no.2. Learned AGP appearing for respondent nos.1 and 3 opposed the application and submits that if at all delay is to be condoned, the claimant/applicant may not be entitled for any interest if amount of compensation is enhanced and on statutory amount.

For the reasons stated in the application in paragraphs 4, 5 and 6, application is allowed, subject to condition that claimant/applicant is not entitled for any interest if amount of compensation so enhanced and on statutory amount.
