According to the learned counsel for the petitioner the affidavit in response of MIDC shall be necessary.

We note that although served there is no appearance on behalf of the MIDC.

However, since Mr. Agnihotri informs us that the Legal Officer of the MIDC has met with an accident and that perhaps could be the reason why instructions are not given by MIDC to the counsel on panel, we request Mr. Agnihotri to appear and assist us on behalf of MIDC.

MIDC shall file an affidavit in response within the next three weeks.
