DATE : 29-03-2023 The appellant has filed the pursis contending therein that the appellant had challenged the judgment and award dated 27-04-19 passed by the learned MACT, Chandrapur, granting compensation to the claimants to the tune of Rs. 16,45,426/- inclusive of NFL amount and excluding the amount of Rs. 5,84,800/-. The appellant has already withdrawn the entire amount of compensation, now the appellant do not want to proceed with the appeal and seeks permission to withdraw the appeal.

The respondents/claimants neither filed separate appeal nor filed any cross objection against the judgment and award. The appellant has no objection to grant the permission to the respondents to withdraw the decretal amount deposited by the appellant as full and final settlement as their entire claim. In view of the

2/2 4 reasons mentioned in the pursis, the appellant is permitted to withdraw civil application along with FA St 863/2021. The respondent nos.1 to 4/original claimants are at liberty to withdraw the amount of compensation which is laying in this Court along with accrued interest. The amount be disbursed to them after due identification and verification.

In view of the order of this Court dated 28-07-2021, the amount of compensation be transmitted in the joint account of respondent nos.1 to 4 on due verification within three weeks from today.

The court fee, if any, be refunded to the appellant as per the rules.

In view of the pursis filed, the appeal is disposed of as withdrawn.
