Heard Mr. S.N. Bawangade, learned counsel for applicant and Mr. N.R.Rode, learned Additional Public Prosecutor for the non applicant-State. Also perused the detailed reply filed on behalf of the prosecution and the entire charge-sheet.

In view of the eye witnesses account and looking to the injuries on deceased Madhukar as well as injured Vilas, when the Court was about to dismiss the application, Mr. Bawangade, learned counsel for the applicant submits that he has instructions from the applicant to withdraw the present application.

The application is dismissed as withdrawn.

Since learned counsel for applicant is withdrawing the application, the Court is not giving detailed reasons for its dismissal.
