As regards the application filed by respondents for permission to withdraw the amount of Rs.25,000/- with interest accrued thereon, learned counsel for appellant submits that he has no objection to transfer the said amount to MACT at Buldhana, however withdrawal of the said amount should be subject to final decision of the Tribunal in the pending claim petition.

Learned counsel for appellant submits that the matter pending before the Tribunal is likely to be decided at the end of this month.

In view thereof, office is directed to transfer the amount to the Tribunal. The Tribunal to decide the application of respondent nos.1 and 2 for withdrawal of the amount after six weeks from today, provided during the said period, the matter is not decided finally. Application is disposed of accordingly.

Heard learned counsel for appellant and respondent.

It is submitted by learned counsel for appellant that as the matter before the trial court is at the stage of final hearing, appellant does not want to press this appeal and appeal may be disposed of as withdrawn.
