The original complainant seeks leave to challenge the judgment passed by the learned Magistrate acquitting the accused of the offence punishable under Section 294 of the Indian Penal Code.
The complainant alleged that the accused while working as P.S.I., Police Station, Akot File had sent the complainant for medical examination falsely accusing that the accused was under influence of liquor, however, the medical certificate issued by the doctor showed that the complainant was not under influence of liquor. According to the complainant, the accused had falsely registered case against the complainant for offence punishable under Sections 110 and 117 of the Maharashtra Police Act. Learned Advocate for the
2 appa48.14 applicant has pointed out that the evidence brought on record is not properly appreciated by the learned Magistrate.
Considering the facts of the case, the applicant is granted leave to file appeal. The appeal be registered.
