IN THE HIGH COURT OF JUDICATURE AT BOMBAY

NAGPUR BENCH, NAGPUR WRIT PETITION NO. 590/2014 (Kapil s/o Ashokrao Bendre vs. Union of India and others ) .......................................................................................................................... Office Notes, Office Memoranda of Coram, appearances, Court's orders Court's or Judge's order of directions and Registrar's orders ................................................................................................................................................................... Mr. R. S.Kurekar, Adv. for the petitioner Mr. N.S.Khubalkar, Asst.Govt.Pleader for 2,4 and 6 CORAM : SMT.VASANTI A. NAIK & A.M.BADAR, JJ.

DATED : 30th March, 2015.

On hearing the learned counsel for the parties, it appears that several disputed questions of fact arise for determination in this Writ Petition.

The petitioner is seeking a direction to the respondents to release the difference of remuneration of the petitioner to the tune of @ Rs.54,600/- .per month. The respondents have seriously disputed that the difference of remuneration is payable to the petitioner.

The issues involved in this case could be decided in a Civil Suit where the parties would be in a position to tender the evidence - both oral and documentary.

In view of the aforesaid, we dismiss the Writ Petition with no order as to costs.

The points raised in the petition are, however, kept open.
