This application filed under Section 528 of the Bharatiya Nyaya Suraksha Sanhita, 2023 seeks quashing of the First Information Report ("FIR") at crime No. 437/2024 registered with Police Station Patur, Tahsil Patur, District Akola for offence punishable under Sections 420, 406 read with Section 34 of the Indian Penal Code at the instance of non-applicant No.2.

The parties have amicably settled the dispute outside the Court and as per the settlement, civil suit pending between the parties. i.e. R.C.S. No. 402/2024 was settled before the National Lok Adalat on 14.12.2024. Additionally, possession of house in question is restored to the non-applicant No.2. Non-applicant No.2 has filed an affidavit making these statements and has no objection to quash the FIR and further proceedings pursuant thereto.

Applicants and non-applicant No.2 are present in the Court. They are identified by their respective Advocates. They confirm about the amicable settlement. Non-applicant No.2 has no objection to quash the proceedings.

In view of the amicable settlement of dispute, application is allowed in terms of Prayer Clause ("A"). 6.

The applicants to pay cost of Rs. 10,000/-to the High Court Legal Services Sub-Committee, Nagpur within four weeks from today towards rotating the investigating machinery.
