BHATKAR,JJ DATE : 20.1.2015 The petitioner challenges the acceptance of the nomination papers of nine persons after 2.00 p.m. on 9.1.2015 i.e. the date fixed for submission of the nomination papers. Perusal of the impugned order would reveal that the said applications were received at 1.00 p.m.. However, the Returning Officer had signed belatedly at 4.00 p.m.. As such there is disputed question of fact. Apart from that, the petitioner can very well take recourse of the Dispute under Section 91 of the Cooperative Societies Act.
