Learned Additional Public Prosecution waives notice on behalf of the State.

Criminal Application (APPA) No.30 of 2017 Heard.

This application is filed for suspension of substantive sentence imposed upon applicants. Learned counsel for the applicants has submitted that both applicants were on bail, pending trial and having been convicted by learned Additional Sessions Judge by its judgment dated 21.12.2016, sentence imposed upon applicants is suspended till .....2/-

21.12.2016. It is, therefore, prayed that the application be allowed and the applicants be released on bail. The applicants are found convicted for the offence punishable under Section 333 read with Section 34 of the Indian Penal Code and are sentenced to suffer rigorous imprisonment for three years and to pay a fine of Rs.3,000/- each, and under Section 326 read with Section 34 of the Indian Penal Code and are sentenced to suffer simple imprisonment for three years and to pay a fine of Rs.2,000 each. The fine amount is stated to be paid by both the applicants.

Considering the fact that applicants were on bail pending trial and as their sentence is suspended as aforesaid, the application is allowed as per order below: The applicants shall be released on bail on their executing P.R. Bonds in the sum of Rs.20,000/- each with one surety in the like amount each. The applicants shall mark their presence with Daryapur Police Station, District Amravati once in six months, pending appeal.
