Heard Shri P.B. Patil, learned counsel for the petitioner and Shri A.S. Fulzele, learned Additional GP for respondent Nos. 1 to 4.

The petitioner, desirous of starting 9th standard in the Academic Year 2017-18, claims that he moved an application seeking necessary permission as per procedure. That application should have been decided before June 2017 but is still pending.

The learned Additional GP points out that this Writ Petition is filed on 12.01.2018 and in it there is no statement that situation has remained unchanged. According to him, because of passage of time, the prayer for starting 9th standard is itself rendered infructuous. 4.

We do not wish to go into this disputed question at this stage. The petitioner has pointed out that he has not received any communication on his request.

We, therefore, grant the petitioner leave to make appropriate representation pointing out all relevant facts within three weeks from today. If such a representation is made, the respondents shall take suitable decision upon it within next eight weeks. If any decision is already taken, it shall be communicated to the petitioner in the meanwhile. 6.

With these directions and keeping all rival contentions open, we dispose of the present writ petition. No order as to costs.
