By the present application, the applicant is seeking anticipatory bail since he is apprehending his arrest in connection with Crime No.996/2017, registered with Police Station Pandharkawda, Tq. Kelapur, Dist. Yavatmal for an offence punishable under Section 420, 468 and 471 of of the Indian Penal Code.

This Court had on 16.01.2018 protected the present applicant by directing the applicant that he shall attend Police Station on 20.01.2018, 21.01.2018 and 22.01.2018 and shall be with the investigating officer from 11.00 a.m. to 05.00 p.m.
Mr. Rode, learned A.P.P. submits that pursuant to the order passed by this Court, the applicant had attended the Police Station and his statement is already recorded.

Perusal of reply shows that the caste certificate was submitted for contesting election by the present applicant however the applicant did not contest the said election. According to the prosecution case, the certificate which was submitted was found to be fabricated one. It is further submitted by the learned A.P.P. that all the documents are already seized by the investigating agency and the investigation is over. Only the formality of filing the charge-sheet is remained to be done.

Looking to the nature of accusations made against the applicant and in view of the fact that the entire investigation is over, in my view, the applicant has made out a case for grant of anticipatory bail.
In that view of the matter, the application is allowed. Order dated 16.01.2018 passed by this Court is made absolute.
The application is disposed of accordingly.
