Heard Mrs. Gauri Venkataraman, learned counsel for the applicant and Shri R.D. Dhande, learned counsel for the respondent.

The effort of the learned counsel for the review applicant is to see that the directions/ observations in para 4 of the order dated 04.12.2017 does not operate as a precedent.

Shri Dhande, learned counsel for the respondent submits that as yet, the petitioner has not been examined by the Competent Medical Board.

We direct the applicant to constitute appropriate Medical Board and let it examine the petitioner and his case. This exercise be completed within a period of six weeks. 5.

We, however, clarify that the order dated 04.12.2017 shall not operate as a precedent in any other matter and the Medical Board so constituted shall not be influenced by any other report or any opinion of other doctors.
