Mr.Sayare, learned counsel for the applicant submits that the reasons cited for delay in filing the First Appeal is substantiated by the applicant through Certificate dated 21.12.2022 issued by one Dr. Jawalkar. 3.

The said certificate is neither part of the record nor there are any pleadings in support thereof.

However, considering the advanced age of the applicant, this Court deems it appropriate to condone the delay in terms of prayer clause, subject to payment of costs of Rs.2000/- to the Family Court Bar Association, Nagpur and the acknowledgment to that effect be produced before this Court within a period of two weeks, failing which the application shall stand dismissed without further reference to the Court.

Subject to compliance of the aforesaid order, issue notice to the respondents, returnable on 2nd May, 2025.

Mr. S.M.Ghodeswar, learned Assistant Government Pleader waives notice on behalf of the respondent nos.1 and 2. 7.

In view of the objections raised by Mr. S.M. Ghodeswar, learned Assistant Government Pleader for respondent nos.1 and 2, we expect the
