Heard Shri A.Y. Kapgate, learned Counsel for the petitioners and Shri W.G. Paunikar, learned Counsel for respondent nos. 1 to 3.

One of the questions raised is, though Chief Executive Officer has expressed some opinion, no final decision about it is still been taken.

Learned Counsel for the petitioners sought leave to add words "decision/opinion" after

Order 1703wp308.15 the word "order" in prayer clause of the writ petition. We grant that leave.

As the contention is, that respondent Zilla Parishad has not taken any decision on the opinion expressed by the Chief Executive Officer, and tender process is, therefore, still hanging in balance, we direct the Chief Executive Officer of Zilla Parishad to take suitable decision on it within a period of one week from today, and to communicate the same accordingly to the respective petitioners forthwith.

Leaving all contentions of petitioners about the merits of the said decision and the tender process open, we dispose of the writ petition. No costs.

Copy of this petition be furnished to the learned counsel for the parties to act upon.
