By this writ petition, the petitioner seeks a declaration that the action on the part of the respondents of withholding the sanction to the proposed construction for shop-cum-multi dwelling units on the plot in Mouza Nari is bad in law.

Shri J.B.Kasat, the learned counsel for the respondent No.2, has tendered an affidavit-in-reply in the Court, today. The same is accepted on record. It is stated that by an order dated 01.08.2016, the respondent No.2 has rejected the plans and statements submitted by the petitioner for the reasons mentioned in the annexure appended to the order, dated 01.08.2016.

In view of the statement made by the learned counsel for the respondent No.2, the cause of action for filing the writ petition is rendered infructuous. The petitioners, are however, free to take appropriate action against the order rejecting the plans and statements, dated 01.08.2016. The writ petition is disposed of with no order as to costs.
