Date : 30 th August, 2016 Shri Dharmadhikari, the learned counsel appearing for the petitioner, submits that the application for amendment of plaint was filed at the appellate stage by the petitioner-defendant, which could not have been filed. Be that as it may, the lower Appellate Court has rejected the application for amendment of the plaint.

In view of this, nothing survives in this petition. The petition is dismissed. The petitioner is at liberty to file an application for amendment of memo of appeal, which shall be decided in accordance with law.
