After hearing learned counsel for both sides for sometime, they are unanimous make a statement that order passed by the Maharashtra Revenue Tribunal dated 14.12.2021 passed in Revision No.REV/TNC/AKO-100/2018 so also order passed by the Sub Divisional Officer, Akot dated 04.10.2018 in proceedings bearing Rev. Case No.TNC107/Mundgaon/02/2014-2015 be set aside. They further request for remitting the proceedings before the Sub Divisional Officer for decision afresh firstly on the point of limitation.

By consent of both sides, the impugned order is set aside so also order passed by the Sub Divisional Officer dated 04.10.2018 in proceedings bearing Rev. Case No.TNC107/Mundgaon/02/2014-2015 stand set aside.

The proceedings bearing in Revision No.REV/TNC/AKO-

wp596.24.O.odt 100/2018 stand relegated back to the Sub Divisional Officer for deciding the application for condonation of delay filed by respondent - trust.

The Sub Divisional Officer to decide this application within a period of eight weeks.

All issues are kept open.

5.

Needless to say that the order of registration of the appeal also stands set aside.

Parties are directed to appear before the Sub Divisional Officer on 18.06.2025.

7.

The Sub Divisional Officer is not required any fresh notice.
