The case against the present applicant is almost identical with the case against the other accused namely Rupesh and Nilesh.

This Court vide order dated 18.02.2016 has allowed the application of the appellant Rupesh whereas vide order dated 11.01.2017, the application of another accused Nilesh has been allowed.

In that view of the matter, we find that the present application also deserves to be allowed on the ground of parity.

The application is, therefore, allowed. The substance sentence imposed on the applicant shall remain suspended during the pendency of present appeal. The applicant is directed to be released on bail on the same terms and conditions as were in the

apeal441-15.odt trial Court, however, with fresh bonds. The other conditions imposed by this Court vide order dated 18.02.2016 in Criminal Application No.743 of 2015 would also be applicable to the present applicant. JUDGE JUDGE halwai
