The petitioner challenges the order dated 09.06.2023 passed by the Divisional Joint Registrar, Money lending cum Divisional Joint Registrar, Co-operative Societies, Amravati and order dated 02.08.2021 passed by respondent No.2 District Deputy Registrar Co-operative Societies, Buldhana under Section 18 (4) of the Maharashtra Money-Lending (Regulation) Act, 2014 (for short, 'the Act, 2014).

The respondent No.3 raised the objection about

17 wp 451.24.odt..odt maintainability of the petition, asserting that an alternate remedy is available under Section 9 of the Act of 2014. 4.

Learned counsel for the petitioner submits that it was specifically pointed out before the Authority that prior to initiating proceedings under the Act of 2014, the issue had already been dealt with before the Civil Court and the matter/point was specifically agitated before the Registrar. 5.

In view of that, without recording any further findings on merits, it is necessary to direct District Deputy Registrar, Co-operative Societies, Buldhana to hear all the parties afresh, by giving them an opportunity of hearing. 5.

In view thereof, petition is partly allowed.

The orders dated 09.06.2023 passed by respondent No.1 and order dated 02.08.2021 passed by respondent No.2 are hereby quashed and set aside. 7.

Both the parties to appear before District Deputy Registrar Co-operative Societies, Buldhan, on 10.11.2025. 8.

In view thereof, writ petition stands disposed of. No order as to costs.
