The present petition has been filed for death parole. It is the contention of the petitioner that the petitioner's child died immediately after taking birth.

Taking into consideration the emergent situation, we had requested the learned A.P.P. to take instructions from the concerned Police Station. The learned A.P.P.

has accordingly received report from the concerned Police Station that it is not the wife of the petitioner, but it is the wife of the petitioner's brother whose son has died immediately after his birth. Hence, no case is made out for grant of death parole. The Criminal Application is, therefore, rejected. JUDGE JUDGE jaiswal
