IN THE HIGH COURT OF JUDICATURE AT BOMBAY

NAGPUR BENCH : NAGPUR WRIT PETITION NO. 855 OF 2018.

(Archana Jugalkishor Mundhada .vs. State of Maharashtra & others) Office Notes, Office Memoranda of Coram, appearances, Court's orders Court's or Judge's orders or directions and Registrar's orders.

Mr. Alok Daga, Advocate for petitioner, Mr. A.R. Chutake, A.G.P. for respondent nos. 1,2,5 & 6. CORAM : B.P. DHARMADHIKARI & MRS. SWAPNA S. JOSHI, JJ. DATED : FEBRUARY 24, 2018.

1] Heard Mr. Daga, learned Advocate for petitioner. 2] He submits that as land of petitioner has been acquired for Samrudhi Highway, petitioner must be paid compensation at the earliest. He also fairly invites attention to communication dated 3.2.2018 sent to petitioner by Executive Engineer of Maharashtra Road Development Corporation, Camp office, Amravati. Said communication is taken on record and marked as Exh. 'X'. We find that in said communication there is reference to some complaint made by Vijay Vasudeo Kamble against the petitioner. 3] The learned A.G.P. has pointed out that said Vijay is not party respondent before this Court and if he is claiming some title in land or interest in compensation amount, behind his back, the petition cannot be entertained.

4] In this situation, we are not inclined to dwell more upon the controversy at this stage. It appears that the Sub-Divisional Officer (respondent no.6) is looking into the controversy. We, therefore,

24.2WP.855.18 direct the petitioner to appear before said Authority on 1.3.2018 and to abide by its further instructions in the matter. Respondent no.6 shall after hearing the petitioner and said Vijay Kamble take suitable decision on grievance of parties within next four weeks. 5] With these directions and keeping all contentions open, we dispose of Writ Petition.

Judge Judge J.
