Mr.S.J.Kadu, learned Additional Public Prosecutor for respondent no.1/State, on instructions, makes a statement that charge-sheet in this crime is filed before the Competent Court.

Mr.R.K.Thakkar, learned Counsel for the applicant thus seeks leave to withdraw the application with liberty to file application for discharge and contended that the matter before the trial Court is fixed on 18.12.2018 for framing of charge; however, as applicant intends to file application for discharge, trial Court be directed to not to proceed for a period of one week.

In that view of the matter, leave, as prayed, is allowed. Application stands disposed of as dismissed since allowed to be withdrawn with liberty in favour of applicant to file discharge application.

Learned trial Court to not to proceed in chargesheet which is filed, arising out of Crime No.451 of 2016
