The order passed by the first appellate Court dated 29.11.2013 allowing the Misc. Appeal filed by the present respondents and vacating the order of interim injunction granted by the trial Court is under challenge. The respondent has filed pursis informing that Regular Civil Suit No. 4660 of 2012 came to be dismissed for want of prosecution on 25.11.2014. In view of aforesaid position the challenge in the present writ petition has been rendered infructuous. Hence, Writ Petition stands disposed of but by clarifying that the remedies of the petitioner are kept open in the event of the suit being restored.
