The learned counsel for the petitioner admits that an amount of Rs.5 Crores is only deposited and balance amount out of Rs.161,00,00,786/- plus 12% interest from the date of default, shall be deposited within a period of two weeks from today i.e. on or before 17.07.2019.

If the entire amount is deposited, on or before the scheduled date, the auction in favour of the petitioner can be maintained, of course subject to

Order 0307wp352.19 other compliances. If the amount is not deposited on or before 17.07.2019, the claim of petitioner shall not survive and respondents shall be at liberty to forfeit the EMD amount, and if permissible in law, for recovery the damages also.

In view of above, Writ Petition is disposed of. No costs.
