Heard Shri P.V. Navlani, learned Advocate for the applicant.

He has pointed out order of this Court dated 19.06.2018. He has pointed out paragraph 4 of the order which reads as under:

"4 If there is no significant development or progress in the trial in the next six months, the applicant is at liberty to apply for bail." Learned Advocate Shri Navlani has submitted that there is no significant development or progress in the trial Court within next six months. Therefore, applicant is entitled for bail. I have gone through the order-sheet of the trial Court. The order-sheet dated 14.08.2018 shows that application for bail under section 439 Cr.P.C. was filed vide Exh.18 the same is pending till today and therefore, trial

ba49.19.O.odt Court could not be proceeded. The applicant/accused cannot take benefit of the same.

Hence, the application is rejected.
