Heard.
Perused the F.I.R., documents placed on record and reply of the prosecution. It is not in dispute that the other similarly circumstanced accused persons, who are eleven in number, have already been granted anticipatory bail by the Sessions Court. If this is so, these applicants cannot be discriminated. Even otherwise, their custodial interrogation does not appear to be necessary.
That apart, this is the case, wherein what was found to be purchased by NAFED was actually more than the quantity that was paid for by the NAFED, thereby indicating that no loss has been caused to NAFED.
In view of the above, I am inclined to allow this application.
aba.35.18 2/2 The application is allowed and the interim anticipatory bail granted to the applicant by this Court on 17th January, 2018 is hereby confirmed on the same conditions except for the condition of their attendance at the police station and now it is directed that they shall attend the police station as and when required.
The application is disposed of accordingly.
