DATE : 28/01/2019 The learned Counsel for the appellant has submitted that the appellant does not want to prosecute the matter further. He also submitted that Pursis St. No.793/2019 to that effect is also filed on record. He, therefore, seeks permission to withdraw the first appeal.

In view of the statements made on behalf of the appellant and in view of the Pursis filed on record by the appellant, the first appeal is allowed to be withdrawn. The first appeal stands disposed of as withdrawn. No costs.

The appellant is entitled for refund of court fees, as per rules.
