DATED : 27-06-2018 The applicant seeks transfer of Summary Criminal Case 1391/2017 pending before the Judicial Magistrate First Class, Pimpri to the Judicial Magistrate First Class, Nagpur.

The transfer is sought primarily on the ground that the divorce petition instituted by the applicant-wife HMP A-307/2017 is pending in Family Court, Nagpur and it would be mutually convenient if Summary Criminal Case 1391/2017 pending at Pimpari is transferred to Nagpur.

The non-applicant has filed on record an affidavit pointing out that the divorce proceedings which were pending before the Family Court are disposed of as compromised. The learned Counsel for the applicant Miss Bajaj does not dispute this position.

Since the proceedings at Nagpur, which was the principle justification for seeking transfer of the proceedings pending at Pimpri to Nagpur have terminated, this application shall have to be rejected. 5.

The application is rejected.
