Though the application is opposed on the ground that the explanation given by the applicant is not sufficient, I find that the applicant has given proper explanation pointing out the reason because of which he could not file appeal within limitation. Accepting the explanation, delay of 107 days in filing the appeal is condoned.

The civil application is allowed accordingly. No costs.
