Shri Mirza, the learned counsel for the respondent, raises a preliminary objection to the tenability of the writ petition. It is stated that a second appeal would lie against the impugned order under Section 35(G) of the Central Excise Act.

In view of the preliminary objection, Shri Kilor, the learned counsel for the petitioner, seeks permission to withdraw the writ petition with liberty to file the second appeal.
