Considering the facts and circumstances of the case, orders impugned in this petition are hereby quashed and set aside subject to payment of cost of Rs. 10,000/- by the petitioner to the respondent within a period of three weeks from today.

Subject to the payment of cost, learned trial Court shall take on record the reply filed by the SKNair

The learned trial Court shall endeavour to decide the application Exhibit 5 within a period of six weeks from the date of receipt of the copy of this order. 4.

The writ petition is disposed of in aforesaid terms.
