Heard.
Perused the F.I.R. and the reply of the prosecution. Two co-accused of this applicant, Narendra Chavan and Vijay Pawar, against whom one criminal case each is pending and who have been identified by the witnesses, have been granted regular bail. While Narendra Chavan was granted regular bail by the Sessions Court, which was later on confirmed when challenged by the prosecution, by this Court by passing an order on 05/07/2017 in Criminal Writ Petition No.165/2017. The other co-accused Vijay Pawar has been granted regular bail on 16/11/2017 by this Court, which order now appears to have become final. The case of this applicant is similar to the co-accused, who are released on bail. If the co-accused were identified and were the persons against whom criminal cases are pending, the same is true about this applicant. This
ba.39.18 2/2 fact is also not disputed by the learned A.P.P. Therefore, I do not see any reason to discriminate against this applicant by denying him the benefit of principle of parity. The application is allowed and it is directed that the applicant be released on bail on his furnishing a P.R. Bond of Rs.50,000/- together with one solvent surety in the like sum on the following conditions :
i.
The applicant shall attend the concerned police station on every Sunday between 04:00 p.m. and 06:00 p.m.
ii. The applicant shall regularly attend the trial Court and co-operate with it in expeditious disposal of the case.
iii. The applicant shall not tamper with the prosecution witnesses in any manner.
The application is disposed of in the above terms. JUDGE *sdw
