IN THE HIGH COURT OF JUDICATURE AT BOMBAY,

BENCH AT NAGPUR CIVIL APPLICATION NO. 348 OF 2017 IN FIRST APPEAL ST.NO.987 OF 2017 Rajendra s/o Amrutlal Adhiya .. Applicant

Versus

The United India Insurance Co.Ltd and ors.

.. Respondents Mr V.B. Gawali, Advocate for applicant Mr Asghar Hussain, Advocate for respondent no.1 Mr R.L.Alone, Advocate for respondents no.4 and 5 CORAM : N.W. SAMBRE, J.

DATE : 13th April 2017 PER COURT Heard.

2.

The application for condonation of delay is strenuously objected by the learned Counsel for respondent no.1-Insurance Company on the ground that delay is not properly explained. 3.

The present appeal is by the vehicle owner who is saddled with the liability to pay the compensation.

4.

Perused the contents of the application. Though day to day delay is not explained, however, there is sufficient reason, in my opinion, to infer that the delay is explained. Hence, delay caused in preferring the appeal is condoned. Civil Application stands allowed. ( N.W. SAMBRE, J.) vvr
