At the outset, learned counsel for the petitioner fairly submits that he has an alternate remedy of preferring an appeal under Section 32 of the Right to Children to Free and Compulsory Education Act, 2009.

Learned counsel for the petitioner seeks permission to withdraw the petition with liberty to file the proceedings under the relevant provision.

Permission is granted. The writ petition is disposed of as withdrawn.

At this stage, it is observed that if such an appeal is preferred within two weeks from today, the concerned authority shall take an appropriate decision within six weeks thereafter. rkn
