The learned counsel for the petitioners, on instructions, seeks permission to withdraw the petition.

Permission is granted. The petition is dismissed as withdrawn. 3.

In view of the notice issued by the respondent-Planning Authority dated 1-10-2018, the petitioners are at liberty to apply for regularization of the plot in question so also the structure thereon under the provisions of the Maharashtra Gunthewari Developments (Regularisation, Upgradation and Control) Act, 2001, the Maharashtra Regional and Town Planning Act, 1966 and such other relevant statutes.

If the application to that effect is made within a period of one week from today, we expect the respondent to take decision on the same expeditiously and in any case within a period of four weeks from reporting compliance of all the shortfalls by the petitioners.
