The petitioner came to be disqualified under Section 39 (1) of the Maharashtra Village Panchayat Act, 1959, vide order dated 12th September, 2023 passed by the Additional Commissioner.

An appeal under Section 39 (3) of the Maharashtra Village Panchayat Act, 1959, is informed to be pending before the respondent-State Government. The stay application moved by the petitioner is informed to have been not decided for last about three months. 3.

In the aforesaid background, the contentions are that directions be issued to State Government to decide appeal as well as stay application expeditiously.

The Additional Government Pleader, who submits that the State Government shall decide the proceedings in due course with a reasonable time. 5.

Having regard to the claim put forth by the petitioner, as reflected in the petition, we deem it appropriate to dispose of the petition thereby directing the State Government to dispose of the appeal expeditiously

(2) wp532.2024 preferred by the petitioner and stay application shall be decided within a period of four weeks from the date of order.
