(Passed on 11.02.2023) The appellant has filed the pursis for unconditionally withdrawing this first appeal. As per counsel for the appellant, the appellant has already deposited the entire decreetal amount together with interest accrued thereon. The appellant has submitted that he does not want to proceed with this first appeal. Hence, the first appeal is disposed of as withdrawn. The respondent/s is/are at liberty to withdraw the decreetal amount, as deposited by the appellant, as per due procedure of law. The requisite court fee be refunded to the appellant, as per rules.
