In this appeal, non-bailable warrant was issued against the appellant by order dated 25.06.2018. Today none appears on behalf of the appellant despite the appeal being called out twice.

The learned APP produced reports dated 13.07.2018 and 6.8.2018 submitted by the Police Inspector of Anti Corruption Bureau, Bhandara. In these reports, it is pointed out that inquiries were made about whereabouts of the appellant. The statements by the two landlords of houses where the appellant has stayed were recorded, wherein it has been stated that the daughter of the appellant had visited the village Arjuni Morgaon and told the said landlords that the appellant died in the year 2016 in Gujarat where he was staying with his said daughter. Although no death certificate or any other document could be procured in that regard, the statements of the said two persons do show that the appellant passed away in the year 2016. These reports are taken on record and marked "X" for convenience.
