The petitioner has challenged the order dated 19.11.2022 passed by Labour Court, Amravati, under Section 48 (1) of the Maharashtra Recognition of Trade Unions and Prevention of Unfair Labour Practices Act, 1971 in Criminal Complaint ULP No.4/2020. Thus, Labour Court, Amravati, issued summons to the petitioner for noncompliance of judgment and order dated 14.11.2014 passed by learned Industrial Court, Amravati, in Complaint ULP No.623//1997.

Learned Counsel for respondent has tendered across the Bar the pursis, stating therein that respondent's grievance has been redressed through the order passed in Writ Petition No.4381/2022, by this Court, whereby the

22 cri wp 24-2023.odt State Government was directed to decide the entitlement of the petitioner to service benefits in pursuance of judgment and order dated 13.11.2014 passed by learned Industrial Court, Amravati. The respondent, therefore, does not wish to prosecute Criminal ULP No.4/2020 pending on the file of learned Labour Court, Amravati. Pursis is taken on record. 3.

In view of above, there appears no reason why should order dated 19.11.2022 passed by learned Labour Court, Amravati, be not quashed as also the proceedings in Criminal ULP No.4/2020. Accordingly, order dated 19.11.2022 passed by learned Labour Court, Amravati in Complaint ULP No.4/2020 is quashed and set aside. 4.

The Criminal Writ Petition is disposed of in above terms.
