3) After hearing respective Counsel for the parties, we find that Shri Nimbalkar had not heard arguments advanced by petitioner on 4/3/2013 and in fact, he joined as Chief Executive Officer, Zilla Parishad, Bhandara sometime in 2015. Thereafter he was transferred elsewhere and currently he is not the Chief Executive Officer of Zilla Parishad, Bhandara. 4) In this situation, it is apparent that cognizance of alleged contempt cannot be taken against Shri Nimbalkar in the present matter. With liberty to petitioner to take such other steps as are open in law, we dispose of the contempt petition. No costs.
