By this petition, the petitioners have challenged the order passed by the JMFC, Court No.6, Akola dated 16/12/2023 rejecting the application filed by the present respondent seeking relief of cancellation of the interim order directing to pay the maintenance. 2.

Learned Magistrate has observed that the petitioners ought to have filed the present application before the appropriate forum for raising his grievance as the impugned order is interlocutory in nature and rejected the application being it is not tenable.

I do not find any illegality in the said order. In view of that, I have shown my disinclination to entertain the petition.

Learned Counsel for the petitioners seeks permission to withdraw the petition with liberty to file appropriate proceeding before the appropriate Court. 5.

Permission is granted.
