Heard Shri V.S. Bapat, learned counsel for the applicant/ respondent and Shri F.T. Mirza, learned counsel for the petitioner.

As we do not see any malafides on the part of deponent Vinod s/o Chandrabhanji Dhote, current Sarpanch of Gram Panchayat, we condone delay and take return filed by him along with additional affidavit on record. Today, Shri Mirza, learned counsel has tendered additional submission pointing out that the entire M.I.D.C. area was excluded from the limits of Gram Panchayat way back in 1988. According to him, therefore, Gram Panchayat could not have levied, demanded or recovered any tax from the petitioner.

Shri Bapat, learned counsel for the applicant/ respondent and Shri A.M. Ghare, learned counsel for noticee Sarpanch are seeking time to file appropriate reply affidavit. List the matter on 30.01.2017 as last chance. JUDGE JUDGE *GS.
