By the present application, the applicant is seeking transfer of Hindu Marriage Petition No. A690 of 2024, pending before Family Court, Nagpur to Family Court, Amravati.

The contention is that, the applicant has also filed proceedings under Sections 12, 18, 19, 20 and 22 of Protection of Women from Domestic Violence Act, before the 4th Joint Civil Judge, Junior Division and Judicial Magistrate, First Class, Amravati and the applicant will have to attend the said proceedings at Amravati. It is further contended that, the applicant has no parents and therefore, it will be very difficult for her to attend the proceedings at Nagpur.

The application is vehemently opposed on the ground that the non-applicant is suffering from kidney disease and one of his kidneys has been

917. MCA No. 26. 2025.odt removed. Therefore, it will be difficult for him to attend the proceeding at Amravati.

Considering the fact that the applicant has no parents and the fact that domestic violence proceedings are pending before the Court at Amravati which the non-applicant has to anyway attend, a case is made out for transfer of Hindu Marriage Petition No. A-690 of 2024 from Nagpur to Amravati.

So far as the difficulty expressed by the nonapplicant regarding attending the proceedings at Family Court, Amravati, I think the non-applicant may attend the said proceeding through Video Conferencing with the permission of the Family Court, Amravati, if such facility is available. Hence, the following order:

The application is allowed.

Hindu Marriage Petition No.A-690 of 2024 is directed to be transferred from Family Court, Nagpur to Family Court, Amravati.

The application stands disposed of.
