It is seen from the record that this court on 3.10.2025 while permitting to carry out the amendment passed the order on Civil Application No.3113/2019 which is basically for the condonation of delay. On that day it was not brought to the notice that Civil Application No.418/2024 for addition of legal heirs of respondent no.1 filed by respondents was pending. 2.

To clarify this ambiguity, Civil Application No.418/2024 is taken for decision.

Accordingly both the parties are heard. For the reasons stated in the application, the application is allowed. The legal heirs of respondent no.1 are permitted to be brought on record.
