2024:BHC-NAG:7287-DB 1 WP-574-2024.odt
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
NAGPUR BENCH, NAGPUR WRIT PETITION NO.574 OF 2024 [Shri Pravin S/o Satyawan Bandre and others VERSUS The State of Maharashtra, through its Secretary, Department of Urban Development, Mumbai and others] Office Notes, Office Memoranda of Coram, appearances, Court'
s orders of directions Court' s or Judge'
s order and Registrar'
s orders.
Shri S.S. Shingane, Counsel for Petitioners.
Shri S.M. Ghodeswar, Assistant Government Pleader for Respondent Nos.1 and 3.
CORAM : NITIN W. SAMBRE AND ABHAY J. MANTRI , JJ .
ATE : 10 th JULY, 2024 1.
The petitioners are working on the posts of Electrician, Motor Mechanic and Turner, in whose favour the recommendation was made by the employerrespondent-Corporation of placing them in the pay-scale of Rs.4000-6000 from the pay-scale of Rs.3050-4590. It is claimed by the petitioners that the said recommendation was approved by the State Government vide its Resolution dated 10-5-2023.
2.
According to the counsel for the petitioners, since the Resolution was passed by the respondent-Corporation on 26-8-2-11 and the similarly-placed employees in the Water Supply Department are granted benefit by the respondent-Corporation vide its Resolution No.342 in the meeting held on 25-11-2008, the petitioners are also entitled for identical relief. 3.
It can be borne out of the record that the Resolution was passed by the respondent-Corporation on 26-8-2011 recommending higher pay-scale.
2 WP-574-2024.odt However, same appears to have been approved by the State Government at much belated stage vide its Resolution dated 10-5-2023. 4.
Whether the petitioners are entitled from the date of the Resolution passed by the respondent-Corporation on 26-8-2011, that too at par with the employees of the Water Supply Department, who were extended benefit vide Resolution passed by the respondent-Corporation on 25-11-2008, is an issue, which purely falls within the ambit and domain of the respondent-Corporation. 5.
In this background, we dispose of the petition with direction to the respondent- Municipal Commissioner to hear the petitioners and pass an order deciding the claim regarding their entitlement of pay-scale with effect from the date of the Resolution, i.e. 26-8-2011.
6.
Let the decision be communicated to the petitioners within a period of six months from today.
Order accordingly. No costs.
