DATED : FEBRUARY 4, 2020 Heard Mr.Kubade, learned counsel for applicant and Mr. Pathan, learned A.P.P. for non applicant-State. Applicant was arrested on 06.12.2019 in connection with Crime No.371/2019 registered with Police Station Khamgaon, Dist. Buldhana for an offence punishable under Sections 354, 294 and 506 of the Indian Penal Code. The FIR is lodged by the victim herself. As per the report, on 12.12.2019, when she had been to the cattle shed that time present applicant came there and with bad intention he held her hand and asked her to come inside the room and also used abusive language.

Though charge-sheet is not yet filed. The investigation papers would show that investigation is over and only filing of the charge-sheet is remained to be done. Further, the offence is triable the learned Magistrate. In totality of the circumstances, I pass the following order.

ORDER

(i) The application is allowed.

(ii) Applicant-Kundan s/o Ramdas alias Ramu Sawadekar be released on bail in connection with Crime No.371/2019 registered with Police Station Khamgaon, Dist. Buldhana for an offence punishable under Sections 354, 294 and 506 of the Indian Penal Code, on he executing P.R. Bond in the sum of Rs.15,000/- with one solvent surety in the like amount.

(iii) Applicant shall attend Police Station Khamgaon, Dist. Buldhana, twice in a week i.e. on every Monday and Wednesday and shall be with the investigating officer from 11.00 a.m. to 05.00 p.m. After filing of the charge-sheet, the applicant shall attend Police Station once in a month i.e. on third Saturday of each month and shall be with the investigating officer from 11.00 a.m. to 05.00 p.m. The application is disposed of.
